Delaware caps residential late fees at 5% of the monthly rent under Del. Code tit. 25, § 5501(d). A lease can agree to less, but a fee above the statutory limit is generally unenforceable no matter what the lease says.
Timing matters as much as the amount: rent must be at least 5 days past due before a late fee can be assessed. A fee charged inside that window isn't collectible in Delaware, even when the lease provides for it.
The fee is capped at 5% of the monthly rent and can't be imposed within five days of the due date; it counts as additional rent under the code. If the landlord doesn't maintain an office in the rental unit's county where rent can be paid, the tenant's due date extends by three more days.
