How late fees are calculated

A late fee only applies once rent is past the grace period. From there the charge depends on the lease: a one-time flat amount, a one-time percentage of the rent, or a recurring daily charge — flat or a percentage — for each day past the grace period. Many states also cap the total, usually as a percentage of the monthly rent.

Grace periods

A grace period is the number of days after the due date before a late fee can be charged. Some states require a minimum grace period; others leave it to the lease. Rent due on the 1st with a 5-day grace period means no fee can be charged until the 7th.

State caps matter

Even when a lease allows a larger fee, many states limit what you can actually collect — often around a small percentage of the monthly rent, sometimes a flat dollar maximum.
